CodyColby
Hello, my company is based in the united states. I know it can vary state to state, but what do I need to do in order to make my hosting company leagal federaly? If anything? Thanks,
freedombi
Sounds like you want to talk to a lawyer. Or maybe your local Small Business Assocation (or equivalent thereof) could help. Any information you get here is not legal advice.
impactgc
Contact your state's "Secretary of State Department". You will be able to register through them directly.. Pricing varies between states for LLC and INC. Adam
SGCH
For a sole proprietorship, go to your county clerk and get a DBA (doing business as) name, then go to irs.gov and get an EIN (employer identification number).
RandyC
Exactly as SGCH said. I however skipped the DBA and just got an LLC, Like you said it strongly does change via state and that is still federally. I recommend that find a friend who is or has a family member that is a lawyer and save yourself some money. I know multiple lawyers and they have helped me greatly. Also be sure to get a Tax ID Number or the IRS will hit you hard especially with obama now he is cracking down hard.
impactgc
I don't think you need a lawyer to help fill out paper work and mail in.. I would suggest talking to a lawyer about the advantages or disadvantages of the different business structures. To get a tax ID.. All you need to do is call the IRS and they will give you one over the phone. Adam

rangermoore
unless you have employees you do not need an EIN

R-n-R
Regardless if you "need" a EIN or not, its a good idea to get one. That way if your a sole proprietor you will not have to be giving out your SSN. In regards to actually incorporating as a entity, regular corporation, or LLC. Here is a good rule of thumb. 1) If you think you are going to have a high liability then incorporate your business 2) If you have built some large assets then incorporate your business. Now the disclaimer....I am not a attorney, you should consult a legal professional to discuss your particular situation.
