TerrasIOI
Hello people, I'm interested to get some suggestions regarding the concept for terms of service text as UK company. In many European countries there is a specific local laws that gives customers 15 days money guarantee etc. Is something similar necessary for UK companies trading on-line? Any chances that I need to relate to some special UK laws in my terms of service? I will appreciate some clarification & tip on good TOS texts to inspire me. Regards.

othellotech
Start by reading the DSR (Distance Selling Regulations) which in summary say you have to have a real address phonenumber on the site clearly displayed as contact information, you have to provide cooling off periods (aka money-back-guarantee) for anything thats not made to order (so domains which are "unique" dont count but hosting does) etc etc

isdoo
Can't say I have ever seen a cooling off period (which is 7 days) on hosting, ADSL or other such services. Maybe it is just well hidden, but I have never seen such info. Yes, I agree if you are shipping items, such as routers - but usually software does not count, and if the item is used, then these no longer applied - so surely if someone uploaded any pages, the 7 day rule would be null and void. Would welcome direction on this, if I am wrong.

As the service is made to order (as in a hosting package is unique to the person who has ordered it), DSR do not apply in the standard way in comparison to ordering a tangible good from the internet. The same goes for services as you have said, the main one I can think of is a phone line. In the BT contract it clearly states that you have the right to cancel and receive a full refund up until the time the line is connected (engineer visit or not).
