custom fields not saved if invalid

i am using some custom fields for customers.

 

in the order process, on step 5 and 6, if a customer forgets to check for example the TOS agreement or he doesn't fill in a field properly he is shown the error list, right?

 

the problem is that the page refreshes and all the fields are still filled, except for the custom ones. they are empty - they don't preserve their values.

 

this is very bothering when using many custom fields as the customer has to fill them again...

 

anyone having this problem?

 

is this a bug or is this the way is supposed to be working?
