Emoji domains put as available by namespinning (even if they're not)

Using namespinning (but also few different lookup providers...) it happens that emoji domains for .com are proposed as available (while it's not, because emoji domains registering is allowed just for few ccTLDs)

So, i.e.,  xn--ls8h.com is proposed as available, and so also for xn--ls8h.net , xn--ls8h.org ...

So it happens that:

  • user try to register xn--ls8h.com
  • system proposes it as available
  • user pays the fee and go on with registration order
  • the registrar obviously gives an error, and does not complete registration
  • user claims "Where's my xn--ls8h.com domain? I registered it! I paid it!!! i want it!!!!!!" (and so on...)

 Any idea on "why" and, most important, how to fix this issue?!?!
