If there's a response from the WHOIS server it checks if the response indicates the domain is available or not. Only if the available text string is found would it report available. If nothing is returned it would return unavailable. Only if the TLD is not supported for lookups which you can see when you view Config > Domain Pricing is the domain always allowed.
