Why have you got :

The live chat addon for WHMCS is available at a special introductory rate of just $6.95/month or $89.95 as a one off purchase (25% discount off the standard retail price of Stardevelop Live Chat). Full licensing options are as follows:

on http://www.whmcs.com/livechat.php

the $89.95 is 25% discount offStardevelop 's price of US$119.95 good BUT NOT GOOD WHEN YOU GET TO THE CART and your price go upto $107.94 USD which is only about 10% off?

 

and as you are in the UK you are not allowed to misslead users like this so will you stick to your words and give the full 25% discount off the standard retail price of Stardevelop Live Chat?

It is perfectly legal to display prices including/excluding vat.

 

If you are vat registered then you would pay the non-vat price, if your not then you would pay the product price + 20% VAT.

 

As you are in the UK you have to pay VAT, if you do not want to, then take it up with the government (and good luck with that).

I am not a Dummy I not all about paying VAT.

 

BUT "25% discount off the standard retail price of Stardevelop Live Chat" is a Sales Promotion as it is promoting the 25% discount so as you do not get a 25% discount but only get about 10% discount this is then misleading advertising both coved by the Advertising Standards Authority as of March 1st 2011.

I fail to see how it is missleading, or, against the ASA's rules. There are numerous companies out there, including big companies, that advertise the same way.

 

Regardless, if your so petty about it, take it up with Matt via a ticket, or don't buy it. Simple.

It may seem wrong to you, but you are aware of the final price and the choice to buy it or not is fully up to you.

It is not so much the price. But put it this way if I was hosting my server's I was selling from LiquidWeb and was selling D/server's the same spec as them but in my name and had on my site and showing in google 90% off the standard retail price of LiquidWeb and then once you got to the cart you was only getting 45% off would that be right and OK to do?

 

Have you ever see "25% inc VAT" on the discount percentage rate (NOT VALUE) given? No as that would be misleading advertising.

 

and as to "I still see numerous companies advertising this way" how is doing it as above?

A very Legal claim and statement: so lets break it down as your lawyer would do. Confirm if any laws were broken and if so, what are they. But also confirm that the statement of advertising or claim is legal and legitimate. Looking at the simple math below, you will find that WHMCS; in fact, not only gives a 25% discount but actually gave more than the 25% claimed.

 

1. Stardevelop retail price of $119.95

2. WHMCS Statement 25% discount ($89.95)

3. Simple Math: $119.95 * 0.25 (or 25%) = $29.9875

4. $119.95 minus $29.99 = $89.96 (Wow WHMCS didn't charge enough).

 

The law states that any discount can only be giving on the product price and cannot discount the tax. Also, it appears Matt is NOT charging enough as he is giving you an additional $0.01 off.

 

Before throwing out a bunch of claims; it would be recommended that a complaint like this when mentioning Ad laws, one would include the tax laws and they are as important to claim.

 

Therefore making false representation is unethical.

Or other way round. (You forgot that, if TAX was added to WHMCS shopping cart, the same will also apply to Stardevelop's cart and the "price" would thus go up)

 

VAT EXCLUDED

 

1. Stardevelop retail price of $119.95

2. WHMCS Statement 25% discount ($89.95)

3. Simple Math: $119.95 * 0.25 (or 25%) = $29.9875

4. $119.95 minus $29.99 = $89.96

 

VAT INCLUDED

 

1. Stardevelop retail price of $119.95 + SAY 10% VAT = $131.95

2. WHMCS Statement 25% discount ($89.95)

3. Simple Math: $131.95 * 0.25 (or 25%) = $32.99

4. $131.95 minus $32.99 = $98.96 + SAY 10% VAT = $100.05

 

Only $7 difference between what WHMCS charged simple because of the VAT exl or incl issue. (And the ad say 25% discount on the product PRICE not on the including VAT (if applicable) price TOO.)
